19th Day of November, 1917
at one o'clock p.m., or thereabout, (being Court Day), proceed to offer for sale, at Public Auction, to the highest bidder, on a credit of six and twelve months, at the Court House door, in Mt. Sterling, Ky., the property mentioned in the judgment, to-wit:
FIRST TRACT.--A certain tract of land located in Montgomery county, Kentucky, at the Southeast corner of the junction of the Mt. Sterling and Levee pike with the Levee and Camargo pike, and bounded as follows: Beginning at the said junction of the Mt. Sterling and Levee turnpike with the Levee and Camargo pike; thence with the Levee and Camargo pike N. 83 3/4 deg. E. 51 88-100 poles; thence N. 82 1/4 deg. 23 36-100 poles to a corner near the toll gate house; thence with what was known as the John Oldham lines 8, 20 1/2 W. 58 24-100 poles to the center of the Mt. Sterling and Levee turnpike; thence up the pike N. 1/4 deg. W. 20 48-100 poles to the beginning, containing 15 acres, 1 rood of land, more or less, and being the same land conveyed to Nannie E. Oldham Stofer by Ida and Blanche McKee by deed dated March 10, 1909, which deed is of record in Deed Book 65, Page 165, Montgomery County Court Clerk's office.
SECOND TRACT.--That certain lot of ground and improvements thereon,situated on the South side of Main street in the city of Mt. Sterling, Montgomery County, Kentucky, and bounded on the North by West Main street and beginning at a corner on the West with the property of John P. Games (now Lila H. McKenna) South to a corner with same, a distance of 192 feet; thence East with said line, a distance of 81 feet and 2 inches to a corner with the Games property and the property of Dr. Ellis Spraft(sic) (formerly Jerry Cockrell;) thence North with the said Spratt's line a distance of 192 feet to Main street; thence with the line of Main street a distance 84 feet to the beginning, and being the same property conveyed by Mrs. C. A. Reid to Nannie E. Oldham (now Stofer) by deed dated March 3, 1896, of record in Deed Book 53, Page 19.
THIRD TRACT.--An undivided one-third interest in and to a certain tract of land in Montgomery County, Kentucky, on the North Fork of Lulbegrud Creek and bounded as follows, to-wit; On the North by the lands of Nannie E. Oldham Stofer and Mary C. Oldham; on the South by the lands of Lewis Knox; on the West and adjacent to the Mt. Sterling and Levee turnpike and containing three-fourths of an acre, more or less; same being the northwest corner lot of a tract of land which was conveyed to Mary J. McKee by Allie L. Smallwood, etc., by deed dated February 17k, 1881, and being the same land conveyed by Ida and Blanche McKee by deed dated January 17, 1902, to Nannie E. Oldham (now Stofer) and the defendants, Mary C. Oldham and Matthew W. Oldham. Of record in Deed Book 63, page 375.
The house and lot in Mt. Sterling, Kentucky, (tract No. 2 above) will be sold subject to a brick street lien in favor of the City of Mt. Sterling, Kentucky, and its contractors for $249.87 with six per cent interest thereon from September 1, 1916.
The purchasers will be required to give bond, with approved security, for the payment of the purchase money, to have the force and effect of a Replevin Bond, bearing legal interest from the date of sale, according to law.
Bonds payable as follows:
To Loula K. Warford for $1,039.35 out of the proceeds of sale of Tract No. 1; to Mrs. W. T. Lyons for $3,163.93, and to John W. Williams for $1,581.97 out of the proceeds of Tract No.2 above; and if that is not sufficient, the balance out of the proceeds of Tract No.1; and to the undersigned Master Commissioner for the balance of the purchase money, if any, of Tracts Nos. 1 and 2, and for No. 3.
The bidders will be prepared to comply with these terms. A lien will be retained on the lands sold until all the purchase money is paid.
