Note: Robert jr known as Rob was lst of Kelly sons to die March 15 1857. He got into a ruckus with OC Search, both were indicted and tried. Kelly was fine $10. Searcy .01 cent. Whatever the cause of it and whatever weapons were used, the record is silent and the file is missing. Dr Wm East who attended him billed the Kelly estate $50. for inflicted knife wounds on Kelly which he underlined in his report. Some speculation is Kelly and Hawks got into some trouble as Hawks [Louisa's husband] d abt this same time also with no records left to view. 11/2001 NSmothers

Note: Robert jr known as Rob was lst of Kelly sons to die March 15 1857. Delilah was dismayed at her son's behaviour and lawlessness and exasperated but tried to hold the family together. 1859 Rob, Lucius Oldham, Ulises Harper & Harrison Jones created a ruckus at the Baptist Church at Sweet Home. Wiley again started some problems at another congregation a couple months later and fined $25. He was fond of the Smothers boys in Halletsville and played cards, faro and put money on the monte bank and basically stayed out of trouble until 1860 when he was charged with the murder of BB Walker, the incumbent county judge by shooting him in the back. Walker had been the Kelly's family lawyer and had written the will for Robert's father, Frank. Little is know or can be found out abt the shooting circumstances. BB Walker was lic to practice law in MS and cut their own capers. In scanning court records there are not any condolences over his demise even though he presided over the Court for 21 yrs. The only hint to what might have happened, being Rob was assoc w/Smothers..Walker was in process of prosecuting the Smothers crows and some other for their lawlessness. Walker had received their wrath as well as the state witnesses as he had them all place under bond to compel their appearance at the proceedings to come. Kelly fled the county aft the shooting and capiases for his arrest said "not found in county". With the call of the docket 1863 the court noted defendant was "dead" and case was dismissed. Some believe he went to MS and joined the Conf Army and might have been killed, no one really knows what happened to him. 11/2001 NSmothers
